What is Shalish? Describe the Nature of Shalish.

Village Shalish:

In rural society, shalish is popular now. Most of the people like shalish when any problem created rather than police. Shalish is an ancient and traditional judgment system in Indian subcontinent. In self-sufficient village community shalish is universal. 

Shalish: 

Shalish means that judgment process which consists by the local people on the basis of area or village. Shalish refers small type of formal judgment which is used for both of ministry or criminal order and to reduce quarrel and opposition. Local powerful person important and respectable persons are play major role in Shalish discussion.

Shalish arrangement prevalent central to python, by this process actual information is explored at first. For this both of plaintiff and inimical are asked and cross examined. Collected their individual opinion and finally a judicial board are consisting by 4 to 8 members. This board is separate from shalish and discuss themselves. Then they declared the result. The pattern of salish is same everywhere in county. But sometimes it seems too different according to area, tradition, custom etc.

Nature of Shalish

Now we discuss the characteristics or nature or features of shalish.

  1. Village Based Judgment Process: Shalish actually village based judgment process. It is not practical in city. In village, shalish is customary and popular.
  2. Formal Judgment: It is the formal judgment system in village. Everyone present this arrangement in a particular day. And people accept the decision which made by shalish.
  3. Sensibility: The main aim of shalish is sensibility. Here tried to establish sensibility between existing parties.
  4. Law: The current state law is less applies here. Traditional law is applying for village shalish. It is sometime harmful for people.
  5. To Reduce Offence: To reduce less type of offences shalish is used. It is used for relating to family problem, to reduce offence etc. 
  6. Constant Decision: Constant decision is occurred by shalish. Here people do not wait for declaration in day after day.
  7. Written Decision: Every declaration is preserve by written way which is called ‘Shalishnama’.
  8. Talismantor Protect Peace: It is called the talishman which is used for protect peace. It is only means by which village rules and regulation are maintained in a proper way.
  9. Ruler:  Usually Shalish is ruled by the powerful member of the society who have more power, higher status. They are the main controller of village power.
  10. Punishment: Here various types of punishment are still now. Fine and financial compensation are used. Cut the hair, to take foot etc. are also used.
  11. Partiality: In this system, everyone is known to all. Sometimes the decision of shalish is given to powerful person.
  12. Established Right Judgment: The contribution of salish is much to established right judgment in village. But ‘Shalish” to reduce fight-conflict etc. 

From the above mentioned it is say that Shalish is not error free. But it has necessity in village.
